GENERAL TERMS:
Mortgage Brokers Network is a licensed Mortgage Brokerage operating in the Province of Ontario. This document is written in plain English, from your perspective: The words “I”, “me”, and “my” mean each client who signs this document below, and the word “you” means our Mortgage Brokerage (hereinafter referred to as “the brokerage”). All words and phrases contained in this Agreement are to be construed in the singular, plural, masculine, feminine or neutral according to the context.
OBLIGATIONS:
I warrant and confirm that all information I provide to you in connection with any mortgage application or other service you provide (a transaction) will be true and correct, and I acknowledge that you and any lenders or other persons to whom you submit that information will be relying on it in order to consider our application and/or determine our creditworthiness. I hereby release you from all claims in damages or otherwise that we may have in connection with or arising from any use, disclosure or release of any of our personal information, and that I will indemnify you against and save you harmless from any and all claims in damages or otherwise which may be made by any third party in connection with or arising from any personal or other information that we have provided to you. I will pay all legal, property appraisal, and registration fees and other costs or expenses incurred by you in connection with a transaction, such costs to be disclosed to me and agreed to before they are incurred by you.
I/We warrant and confirm that the information given in the mortgage application form is true and correct and I/We understand that it is being used to determine my/our credit responsibility and to evaluate and respond to my/our request for mortgage financing. You are authorized to obtain any information you may require for these purposes from other sources (including, for example, credit bureau) and each source is hereby authorized to provide you with such information. I/We also understand, acknowledge and agree that the information given in the mortgage application form as well as other information you obtain in relation to my credit history may be disclosed to potential mortgage lenders, mortgage insurers, other service providers, organizations providing technological or other support services required in relation to this application and any other parties with whom I/We propose to have a financial relationship.
I/We acknowledge that mortgage brokerage or mortgage broker/agent is at the mercy of the lenders and insurers regarding conditions that must be fulfilled in order for a mortgage to fund. This section indemnifies us and holds us free from harm should we perform our duties properly, yet the mortgage does not fund as a result of the lender or insurer conditions not being fulfilled for any reason other than our negligence as the mortgage brokerage or mortgage broker/agent for the transaction.
I/We further acknowledge and agree that each mortgage lender, mortgage insurer or service provider to whom you provide the mortgage application and/or my/our personal information is permitted to receive such application and information and maintain records relating to me/us and my/our mortgage application and to hold, use, communicate and disclose personal information about me/us, including my/our Social Insurance Number (SIN) if I/We provide it, and collect personal information from me/us, you and from third persons, including credit bureau, credit reporting and collection agencies, financial institutions, my/our past and present employers, creditors and tenants, my/our spouse or any other person who has information about me/us for the purpose of recording, evaluating and responding to my/our application for mortgage financing or related activities and I/We specifically consent to the release and disclosure or personal information by such persons to and among you and each potential mortgage lender, mortgage insurer or other service provider.
I/We further acknowledge and agree to the receipt of emails regarding periodic market updates, information on how to improve my/our credit, as well be contacted when my/our mortgage is up for renewal unless otherwise indicated in writing.
